The Monterey Bay National Marine Sanctuary (MBNMS) Advisory Council met on Thursday, August 1, 2002, at the Cambria Veteran’s Memorial Hall, California. Public categories and government agencies were present as indicated:

I. CALL TO ORDER, ROLL CALL

The Sanctuary Advisory Council (SAC) held this special meeting to hear comments on the Joint Management Plan Review (JMPR) from communities in the southern section of the sanctuary. Over 60 people attended the meeting. In attendance were City Council members from Morro Bay, commercial fishermen, members of environmental organizations, and residents of San Luis Obispo County. Thirty-one people addressed the advisory council with their concerns. Many issues were raised, with the more common being the expansion of the Sanctuary boundary to the south and the sanctuary’s role concerning fisheries management.

The meeting adjourned at 9:40pm.

I. CALL TO ORDER, ROLL CALL.

MOTION: (Passed)

The SAC unanimously adopted the minutes from the June 7, 2002 Sanctuary Advisory Council meeting, with the following changes.

  • Add sentence on page 4, fourth paragraph down, that BTAP members, as well as some SAC members, felt that the overall tone of the BTAP cruise ship letter was positive.
  • The addition of a sentence on page 6, first paragraph, stating that some SAC members did not see the draft CWG letter before the meeting that was drafted to Helen Golde regarding special use permits.

Motion introduced by Dan Haifley, seconded by Dave Ebert
(Vote: 17 in favor, 0 opposed (unanimous))

II. PUBLIC COMMENT ON ITEMS NOT ON THE AGENDA

Chet Forrest provided an enthusiastic statement about the oceans and the sanctuary program. He also stated that most residents of Cambria support southern expansion of the boundary of the MBNMS.

Paul Barrish suggested that there be a military presence on the SAC.

Max Camarillo, a Seacliff beach resident, asked the council to please choose a site for the visitor center that would have the least impact on residents.

Pat Camarillo, a Seacliff beach resident, supports a visitor’s center, but does not think that Seacliff is the appropriate place for one. Stephanie asked Ms. Camarillio if she could please submit a list of alternative sites for the visitor’s center.

III. PRESENTATION: DAVIDSON SEAMOUNT

MBNMS Research Coordinator, Andrew DeVogelaere gave an informative presentation on the Davidson Seamount along with Greg Cailliet, Moss Landing Marine Laboratories and Randy Kochevar, Monterey Bay Aquarium. They gave a power point presentation of what was found during the exploration of the seamount located 80 miles southwest of Monterey. They also discussed the extensive media and education components of the project. Also shown was a video that will be played as part of the flight movie news brief on American Airlines.

No action was taken by the SAC.

IV. PRESENTATION: PROPOSED LIST OF PRIORITY ISSUES FOR THE JOINT MANAGEMENT PLAN REVIEW (JMPR)

Sean Morton, Management Plan Coordinator, presented the Priority Issues to address in the JMPR. He explained that SAC members were being asked to comment on the cross-cutting and site-specific issues. He answered questions from several SAC members and reviewed and clarified the information found on table 4.1.

V. PUBLIC COMMENTS ON THE JMPR

Shirley Bianchi stated that there are three issues that need special emphasis: 1) Clarifying the role of the Monterey Bay sanctuary with respect to fishing activities 2) evaluating the need for boundary expansion, identify benefits and addressing the need for local control 3) Addressing impacts from sedimentation (on-shore improper grading practices).

Patricia Wilmore, San Luis Obispo Chamber of Commerce, stated that local communities should have an influence on sanctuary issues.

Steve Scheiblauer, Harbormaster of Monterey, suggested three issues that he believes need the Council’s attention: 1) the SAC Charter and Protocols 2) a specific change in the language regarding fishing issues 3) a clarification and simplification of dredging permits.

Colby Crotzer, Morro Bay City Council member, would like to see a separate central coast sanctuary for the waters off Morro Bay. He also urged the Sanctuary Advisory Council to discuss the establishment of a local working group to tackle the issue of boundary expansion.

Shoosh Crotzer submitted a petition with 750 signatures of residents that supports southern expansion of the sanctuary. She also strongly supported establishment of a local working group to address the issue.

Gary Ruggerone, Caltrans, was pleased to see that Caltrans landslide management was a priority, but commented that landslides occur in other areas other than Big Sur. He would like to see item 16D, Marine Discharge and Debris (landslide disposal), given a higher priority.

Alan Graves, SOS Policy Coordinator, believes that cruise ships should be addressed as a water quality point source pollution issue and that it be made a higher priority. He also believes that acoustics and oil development should be higher priorities.

VI. PROPOSED LIST OF PRIORITY ISSUES FOR THE JOINT MANAGEMENT PLAN REVIEW: DISCUSSION AND SAC ACTION REQUIRED

Just before lunch, the SAC began discussion about the JMPR. Questions were raised about cross-cutting issues and how they are going to be addressed

VII. PUBLIC COMMENT ON JMPR (CONTINUED)

One other member of the public spoke after lunch about concerns related to MTBE and asked the SAC to look at this more seriously. Holly Price from the Sanctuary staff responded that this was an issue the office was tracking closely that this is primarily a ground water concern and that there was no evidence to date of discharges of MTBE into the MBNMS or damage to Sanctuary resources.

VIII. PRIORITY ISSUES DISCUSSION CONTINUED:SAC ACTIONS TAKEN

Motion by Dan Haifley, 2nd by Harriet Mittledorf:
The SAC accepts table 4.1 as proposed.

Approved, at end of meeting after amendments were taken and approved (see below), by vote 16-0.

Note: Motions to amend #1-8 below pertain to the Site-Specific intended priorities as shown in July 8, 2002 report. Motion to amend #9 pertains to Cross Cutting priorities.

Motion to amend #1, by Kaitilin Gaffney, 2nd by Stephanie Harlan:
Support local working group to explore options for expanding southern MBNMS boundary or other alternatives.

Approved, by vote 11-6.

Motion to amend #2, by Chris Harrold, 2nd by Kaitilin Gaffney:
Change the title of “Partnerships with Agencies (Big Sur Coastal Ecosystem Plan)” to “Develop Coastal Ecosystem Plan for Big Sur”.

Approved, by vote 17-0.

Motion to amend #3, by Chris Harrold, 2nd by Dan Haifley:
Add a cell that incorporates tools and strategies to achieve high priority goals. Tools and strategies known at this time include: Education; Other partnerships – Public and Private; Research; Enforcement; SIMoN; and, Outreach.

Approved, by vote 17-0.

Motion to amend #4, by Kaitilin Gaffney, 2nd by Stephanie Harlan:
Add to the priorities the development of a regional action plan for cruise ships.

Motion withdrawn after discussion.

Motion to amend #5, by Brian Foss, 2nd by Stephanie Harlan:
Add to the priorities a review of the SAC Charter and Protocols as part of the JMPR.

Fails, by vote 5-10 (2 abstain).

Motion to amend #6, by Dave Ebert, 2nd by Chris Harrold:
The review of Personal Watercraft should be dropped from the priorities as an issue in the JMPR.

Fails, by a vote 1-15.

Motion to amend #7, by Dan Haifley, 2nd by Harriet Mittledorf:
Move the issue of Personal Watercraft so it falls under “Wildlife Disturbance”, while retaining the 3 sub-bullets to the PWC issue as shown in report.

Approved, by vote 14-1 (1 abstain)

Motion to amend #8, by Tom Canale, 2nd by Dan Haifley:
The SAC adopts the statement by the Alliance of Communities for Sustainable Fisheries and ask that the MBNMS use it as a guideline for clarifying language on fishing issues. The language reads as follows:

Fishing: Clarify that DFG (including the California Fish and Game Commission) and NMFS (including Pacific Fisheries Management Council) are the primary agencies responsible for fishing regulation and ensure that any zones or regulations proposed that affect fishing occur only out of a cooperative dialogue with fishing and/or aquaculture communities and are supported by them. Recognize, in writing, that Sanctuary policies affecting fishing may integrate with management tools promulgated by the state and federal governments, but are not intended to augment or supercede them.

Fails, by vote 6-10.

Motion to amend #9, by Kaitilin Gaffney, 2nd by Dave Ebert:
Move all fishing activities to be addressed for MBNMS out of Cross Cutting issues and handle them as MBNMS Site-Specific priority issues.

Approved, by vote 11-0.

IX. SAC ANNOUNCEMENTS

Richard Nutter made very positive statements about the MBNMS WQPP and the voluntary stewardship initiatives of the Agricultural industry and 6 county Coalition of Central Coast Farm Bureaus.

Bill gave an overview of the September 20th community forum on ocean conservation to be hosted by Leon Panetta, with guests Julie Packard and Jean-Michel Cousteau. Bill invited everyone on the SAC to the event as the Sanctuary’s guest.

Stephanie announced the AMBAG dinner event for September 21st featuring Leon Panetta, Congressman Sam Farr, the past and current SAC chairs and many local government representatives.

Chris Harrold mentioned PISCO’s newsletter, passed around a copy and gave out their website address.

X. UPDATES

Michele Roest, MBNMS Education and Outreach Specialist, gave the SAC a preview of the MBNMS Anniversary events to be held in San Simeon/Cambria on September 7th.

Kathryn Karako, Director of Friends of the Elephant Seal, provided a status report and spoke about two of their education and data collection programs-the Royal Laguna program and the Census program.

XI. ACTIONS: SET OCTOBER SAC MEETING AGENDA

Carmel Valley was suggested as the next meeting site.

The meeting adjourned at 4:30 p.m.
